Overview

To ensure every case is handled fairly and consistently, OPHD follows UC policies and campus procedures for discrimination and harassment complaints. OPHD’s role in the resolution processes is neutral. We aim to treat everyone involved with dignity and respect, while providing a fair and transparent process.  Support and advocacy resources are available outside of OPHD for anyone who needs them during the process.

OPHD can respond to a report in many ways. To learn more about these options, visit:

If you have any questions, feel free to reach out to ophd@ucmerced.edu

What happens after a report has been filed?

Once a report has been filed, OPHD will reach out to the Complainant (the impacted person) by email unless the report indicates that a phone call is best. The outreach includes resources, including confidential options, and invites the Complainant to meet with us.

If a Complainant chooses to meet with OPHD, they will have an opportunity to share information about their report, ask questions, request supportive measures, discuss their concerns and options, and the next steps.

Right to an Advisor and/or Support Person

Both the Complainant and the Respondent have the right to have an advisor and/or support person present with them at any meeting or interview with OPHD.  An advisor/support person may include, but is not limited to, a union rep, family member, partner or friend, counsel, CARE Advocate, or Respondent Services Coordinator.  However, potential witnesses may not serve as advisors or support persons (see FAQ#1, SVSH Policy, FAQ#9, Anti-Discrimination Policy).

All advisors/support persons must sign an Advisor/Support Person Agreement before they can participate in any OPHD process or meeting.  If a student requests to have an advisor and/or support person present, the advisor/support person must also sign a FERPA waiver.
